By accessing or using Cull (“the Service”) at cull.studio, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

Cull is a private video gallery platform that allows event videographers to share event footage with their clients. Access to galleries is granted by invitation only. The Service is provided “as is” for personal, non-commercial use.

• You must provide a valid email address to access the Service.
• You are responsible for maintaining the confidentiality of your account credentials.
• You may not share your account access with others or allow unauthorised persons to view private galleries.
• You must notify us immediately if you believe your account has been compromised.

All video content, photographs, and media available through the Service (“Content”) are owned by the videographer who created them and are protected by copyright law.

• Content is made available to you for personal viewing and personal archival download only.
• You may not redistribute, resell, publicly broadcast, or commercially exploit any Content without the express written permission of the content owner.
• Downloading clips is permitted solely for your own personal, non-commercial use.

You agree not to:

• Attempt to gain unauthorised access to any gallery or account.
• Scrape, crawl, or systematically download content from the Service.
• Use the Service for any unlawful purpose or in violation of any applicable law.
• Transmit any malware, spam, or harmful code through the Service.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CULL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR LOSS OF CONTENT, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED $100 USD.

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time.

We may update these Terms from time to time. We will provide notice of material changes by email or by posting a notice on the site. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
